{"id":47785,"date":"2014-12-18T15:27:28","date_gmt":"2014-12-18T14:27:28","guid":{"rendered":"https:\/\/www.tibagroup.com\/nova-sobretaxa-de-baixo-teor-de-enxofre\/"},"modified":"2025-06-10T13:42:59","modified_gmt":"2025-06-10T11:42:59","slug":"sobretaxa-lss-jan-2015","status":"publish","type":"post","link":"https:\/\/www.tibagroup.com\/pt\/comercio-exterior\/regulamentos\/sobretaxa-lss-jan-2015","title":{"rendered":"Nova sobretaxa de Baixo Teor de Enxofre LSS"},"content":{"rendered":"<p>Os armadores t\u00eam vindo a anunciar a implementa\u00e7\u00e3o de uma nova Sobretaxa de Baixo Teor de Enxofre (LSS, <em>Low Sulphur Surcharge<\/em>) tendo como justifica\u00e7\u00e3o a necessidade de compensar custos adicionais em que v\u00e3o incorrer pela substitui\u00e7\u00e3o dos combust\u00edveis por uma op\u00e7\u00e3o mais limpa nas \u201c\u00c1reas de Controlo de Emiss\u00f5es\u201d (ECA,<em> Emission Control Areas<\/em>). Estas altera\u00e7\u00f5es ir\u00e3o dar resposta ao exigido pela regulamenta\u00e7\u00e3o ambiental internacional, a qual dever\u00e1 entrar em vigor a partir do dia 1 de Janeiro de 2015.<\/p>\n<p>As denominadas \u201c\u00c1reas de Controlo de Emiss\u00f5es\u201d (ECA, Emission Control Areas) est\u00e3o localizadas no Norte da Europa (incluindo Mar B\u00e1ltico, Mar do Norte e Canal da Mancha) e na Am\u00e9rica do Norte (200 milhas n\u00e1uticas a partir da costa americana e canadiana), conforme indicado no mapa abaixo.<\/p>\n<div id=\"attachment_1606\" style=\"width: 436px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" aria-describedby=\"caption-attachment-1606\" class=\"wp-image-1606\" src=\"\/wp-content\/uploads\/2023\/11\/ECA.webp\" alt=\"ECA\" width=\"426\" height=\"344\" \/><p id=\"caption-attachment-1606\" class=\"wp-caption-text\">Mapa das &#8220;\u00c1reas de Controlo de Emiss\u00f5es&#8221; (ECA)<\/p><\/div>\n<p>&nbsp;<\/p>\n<p>Nas \u201c\u00c1reas de Controlo de Emiss\u00f5es\u201d as companhias de navega\u00e7\u00e3o ser\u00e3o obrigadas a reduzir determinados tipos de emiss\u00f5es dos navios, tais como \u00f3xidos sulf\u00faricos (Sox) ou \u00f3xidos nitrosos (Nox).<\/p>\n<p>A principal raz\u00e3o desta regulamenta\u00e7\u00e3o \u00e9 a protec\u00e7\u00e3o do meio ambiente e o impacto positivo na sa\u00fade, j\u00e1 que as emiss\u00f5es sulfurosas s\u00e3o t\u00f3xicas e causam problemas respirat\u00f3rios, al\u00e9m da chuva \u00e1cida. As emiss\u00f5es de enxofre (SOx) provenientes das opera\u00e7\u00f5es dos navios dever\u00e3o ser reduzidas em 90% nas \u00e1reas ECA.<\/p>\n<p>Ora, o combust\u00edvel com conte\u00fado de enxofre de 0,1%, &#8211; exigido em \u201c\u00c1reas de Controlo de Emiss\u00f5es\u201d &#8211; \u00e9 bastante mais caro do que o combust\u00edvel com conte\u00fado de 1,0% de enxofre, pelo que os armadores alegam que ter\u00e3o de cobrar uma sobretaxa devido aos custos adicionais com este combust\u00edvel mais ecol\u00f3gico.<\/p>\n<p>Temos vindo a assistir a sucessivos an\u00fancios dos armadores, constatando n\u00e3o s\u00f3 valores muito d\u00edspares nos pre\u00e7os da sobretaxa LSS, como diferentes crit\u00e9rios de aplica\u00e7\u00e3o, a saber:<\/p>\n<p style=\"padding-left: 30px;\">1)<strong> Crit\u00e9rio por rota:<\/strong> a sobretaxa \u00e9 cobrada se o navio passa por uma das \u201c\u00c1reas de Controlo de Emiss\u00f5es\u201d;<br \/>\n2)<strong> Crit\u00e9rio por local de carga:<\/strong> a sobretaxa \u00e9 cobrada apenas se a carga \u00e9 oriunda de um local inserido na \u201c\u00c1reas de Controlo de Emiss\u00f5es\u201d.<\/p>\n<p>A regulamenta\u00e7\u00e3o das \u201c\u00c1reas de Controlo de Emiss\u00f5es\u201d (ECA) foi desenvolvida e ratificada pelos estados membros da Organiza\u00e7\u00e3o Mar\u00edtima Internacional (IMO) e est\u00e1 previsto entrar em vigor no in\u00edcio do pr\u00f3ximo ano, com efeitos ainda por avaliar no \u00e2mbito do com\u00e9rcio internacional.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A nova sobretaxa de baixo teor de enxofre (LSS, Low Sulphur Surcharge) para o transporte mar\u00edtimo entrar\u00e1 em vigor a 1 de Janeiro de 2015.
