IMPORTING MEDICAL DEVICES, PHARMACEUTICALS, AND COSMETICS IN PERU

Importation of pharmaceuticals, medical devices, and hygiene products into Peru is regulated by the Ministry of Health (MINSA in its Spanish acronym) through the Directorate General of Medicinal Products, Supplies, and Drugs (DIGEMID in its Spanish acronym) as the National Authority for Pharmaceuticals, Medical Devices, and Hygiene Products (ANM in its Spanish acronym), which has to ensure compliance with Supreme Decree No. 016-2011-SA.

Requirements for importing pharmaceuticals, medical devices, and hygiene products into Peru

If you’d like to import pharmaceuticals, hygiene products or medical devices into Peru, apart from the basic documentation for any imports you’ll also need to meet some minimum requirements. There may additionally be further prerequisites depending on the tariff classification of the goods:

  • Health registration or exceptional import license
  • Manufacturing batch and expiration date, and serial number or identification code for hygiene products or medical devices
  • Certificate of analysis
  • Certificate of good manufacturing practices

HEALTH REGISTRATION AND EXCEPTIONAL IMPORT LICENSE IN PERU

All items classified as medical devices and therefore requiring Health Registration must be imported and/or distributed through a pharmaceutical wholesaler. Health registration has to be processed via a company incorporated in Peru authorized by DIGEMID to operate as a pharmaceutical establishment or wholesaler and which also has a health permit and Good Storage Practices (GSP) certification.

During a state of emergency as set forth in Supreme Decree No. 016-2011-SA, as an interim measure DIGEMID may authorize the importation of medical devices or hygiene products without requiring Health Registration by means of an Exceptional Import License. In order to be eligible for this kind of license:

  • The procedure has to be carried out via DIGEMID’s filing office by submitting technical documentation and the supporting documents required by law to back up the application.
  • Just like the health registration of a product, exceptional import licenses can only be obtained through a pharmaceutical wholesaler and not via any other type of company or individual.
  • Once the health registrations and licenses have been acquired, the products sent by the supplier will need to have the importer’s data on each unit and will be shipped with the invoice and packing list in the name of the importing pharmaceutical wholesaler.
