TRADE AGREEMENTS BETWEEN ALGERIA AND THE EU

“As part of the Euro-Mediterranean Partnership (Euromed), Algeria has an Association Agreement with the EU which came into force in September 2005. This grants it duty-free access to the European market for manufactured goods and preferential treatment for agricultural products, processed agricultural products and fishery products.

In September 2007 it endorsed the EU’s new pan-Euro-Med system of ‘cumulation of origin’ and signed the Regional Convention on Preferential Rules of Origin for the Pan-Euro-Med area in 2012. The system was originally based on a network of Free Trade Agreements with identical origin protocols.

These individual origin protocols are progressively being replaced by the Regional Convention on Pan-Euro-Mediterranean Preferential Rules of Origin (PEM Convention), which was established in 2011 to provide a more unified framework for origin protocols and is expected to be applicable in 2021. Algeria acceded to the Regional Convention in March 2017.

Rules of origin

The applicable rules of origin can be found in Protocol 6 of the Association Agreement with the EU.

  • Tolerance: 10% of the ex-works selling price of the product for all products, except for clothing and textiles for which a specific tolerance applies.
  • Cumulation: bilateral cumulation, diagonal cumulation (products having obtained originating status in one of the countries of the pan-Euro-Mediterranean cumulation zone may be added to products originating in any other country of the zone without losing their originating status within the zone itself) and full cumulation may be applied in trade between the EU, Algeria, Morocco and Tunisia.
  • Direct transport: documentary evidence of direct transport must be presented to the customs authorities of the importing country.

Proof of origin

Under the applicable rules of origin and in order to benefit from preferential customs duties, products originating there must be accompanied by a EUR.1 movement certificate issued by the customs authorities.

It is also part of the Pan-Euro-Mediterranean agreement and so the EUR-MED certificate will be used when three or more countries of the agreement are involved.

Any exporter can prove the origin of the goods by means of an invoice declaration or invoice declaration EUR-MED when the value of the goods is €6,000 or less. Authorised exporters may do so for shipments of any value.

The maximum value limit of the exemption from the requirement to present a proof of origin for small packages sent from one private person to another is €500 and for goods contained in travellers’ personal luggage, it is €1,200.”
